
Islamabad: The Constitutional Bench of the Supreme Court of Pakistan has referred the petition challenging the detention of Dr. Mahrang Baloch, a leader of the Baloch Yakjehti Committee (BYC), to the Practice and Procedure Committee for hearing before a regular bench.
The hearing on the petition was conducted by a five-member constitutional bench headed by Justice Aminuddin Khan. During proceedings, petitioner’s lawyer Faisal Siddiqui argued that the case should be heard by a regular bench rather than a constitutional bench.
Justice Muhammad Ali Mazhar observed that since the petition challenges an MPO (Maintenance of Public Order) order, it qualifies as a case for the constitutional bench. Siddiqui countered that the appeal only challenges the MPO order and does not seek interpretation of the law.
Subsequently, the constitutional bench referred the petition to the Practice and Procedure Committee for further consideration.
It is noteworthy that in June 2025, Dr. Mahrang Baloch’s sister, Nadia Baloch, approached the Supreme Court against her sister’s detention. Nadia had requested that the April 15 order of the Balochistan High Court, which had dismissed the petition against Dr. Mahrang Baloch’s custody, be declared void.
Dr. Mahrang Baloch is currently imprisoned in Quetta’s Huda District Jail, following her arrest on March 22 under the Maintenance of Public Order laws, on the orders of the Deputy Commissioner.
